Terms of service.

Operator: Pilbara Gaming Development Pty Ltd (trading as Red Dog Studios / Developed by Red Dog Studios) (“Farlands”, “we”, “us”, “our”).
Platform: Farlands™ Ecosystem (including farlands.world and portal.farlands.world), and any related apps, smart contracts, content, and services (collectively, the “Platform”).
1. Acceptance of Terms
By accessing or using the Platform, you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Platform. These Terms apply to all visitors, users, and contributors.
2. Privacy Policy
Your use of the Platform is also governed by our Privacy Policy, which is incorporated by reference and describes how we collect, use, disclose, and protect personal information in connection with the Platform, including web3/blockchain-related identifiers, logs, and cookies/analytics.
3. Eligibility
You must be at least 18 years old (or the age of majority where you live) to use the Platform.
The Platform is not intended for children under the age required by applicable law without parental consent. If you believe a child has provided us personal information, contact us at team@farlands.world.
4. Purpose of the Platform
The Platform provides digital entertainment experiences and game-related services, including access to in-game utilities, features, and digital items, and may include a blockchain-based utility token used within the Farlands ecosystem.
No financial services or advice. The Platform does not provide financial, investment, legal, or tax advice and does not provide brokerage, exchange, custody, or investment services of any sort.
5. Wallets, private keys, and authentication
Some features require you to connect a third-party wallet. Wallet providers are third parties and you use them under their terms.
You are solely responsible for:
securing your wallet, device, private keys, seed phrase, and credentials;
reviewing and confirming transaction details before you approve them (including chain, contract address, recipient address, approvals/allowances, gas/fees, and parameters);
any activity undertaken through your wallet connection.
No key custody. We do not collect private keys or seed phrases, and we will never ask you for them.
6. Digital items, in-game utilities, and availability
The Platform may provide access to digital items and utilities (including in-game items, cosmetics, access entitlements, and other digital content) (“Digital Items”). Digital Items may be recorded off-chain, on-chain, or both.
Unless we expressly state otherwise:
Digital Items are provided for use within the Platform and ecosystem features we make available;
Digital Items are not money, are not redeemable for fiat currency, and have no guaranteed real-world value;
we may change, rebalance, suspend, or remove Digital Items or utility features for security, compliance, integrity, maintenance, gameplay balancing, or operational reasons.
7. Utility token disclaimer ($FES)
The Farlands utility token (“$FES” or similar) is intended to be a digital utility token for use within the Farlands ecosystem.
You acknowledge and agree that:
$FES is intended solely for functional use within the ecosystem;
$FES is not an investment, security, equity interest, or promise of profits, yield, or appreciation;
any acquisition, holding, or use of $FES is voluntary and at your own risk.
8. Blockchain & transaction risk
Blockchain networks are public by design. Transactions and related metadata may be visible publicly and may persist indefinitely.
Blockchain transactions are generally irreversible and may fail, be delayed, or be reordered due to network congestion, outages, forks, upgrades, validator performance, smart contract behaviour, third-party infrastructure limits, or user error.
We do not control Solana, Ethereum, or any other blockchain network, nor third-party explorers, indexers, RPC providers, wallets, bridges, or protocols, which you use at your own risk.
9. Fees, network costs, and third-party charges
You may incur:
Platform fees (if disclosed at the point of use); and
third-party fees such as gas/network fees, validator fees, protocol fees, bridge fees, wallet/provider fees, slippage, and MEV impacts.
We do not control third-party fees or network conditions, and fee estimates may be inaccurate.
10. Fulfilment & technical limitations
While we aim for accurate and timely fulfilment of Digital Items and utilities:
delays may occur due to technical, network, or third-party service issues;
ledgers/indexers may be temporarily unavailable or out of sync;
some fulfilment may be asynchronous.
We may pause, delay, limit, reverse (where technically possible), or correct fulfilment where we reasonably believe it is necessary to maintain system integrity, fairness, security, or compliance.
11. User responsibilities
You agree to:
use the Platform lawfully and in accordance with these Terms;
provide accurate information where required;
understand the risks of digital assets and blockchain interactions.
You are solely responsible for losses resulting from wallet mismanagement, wrong addresses/networks, approvals/allowances you grant, scams/phishing, user error, or third-party failures.
12. Prohibited use
You must not:
exploit or attempt to exploit vulnerabilities;
circumvent safeguards, access controls, or limits;
use bots, scripts, scraping, or automated systems without our written permission;
engage in fraudulent, deceptive, abusive, or unlawful behaviour;
interfere with the Platform’s operation or other users’ enjoyment.
We may restrict, suspend, or terminate access for violations.
13. User content (if you submit anything)
If you submit content (e.g., usernames, messages, feedback, media) (“User Content”), you:
confirm you have the rights to submit it; and
grant us a worldwide, royalty-free, sublicensable licence to host, use, reproduce, modify, display, and distribute it only to operate, maintain, improve, and promote the Platform (subject to the Privacy Policy for any personal information).
14. Intellectual property
All content, branding, game concepts, artwork, code, and trademarks on the Platform are owned by or licensed to Farlands (excluding third-party services and assets you hold in your wallet).
You receive a limited, revocable, non-exclusive, non-transferable licence to access and use the Platform for personal, non-commercial use (unless we expressly permit otherwise). No rights are granted by implication.
15. Third-party services and links
The Platform may integrate or link to third-party services (wallet providers, explorers, Discord, X, Google analytics, hosting, RPC/indexing providers, etc.). Those third parties have their own terms and privacy practices, processes and procedures.
We are not responsible for third-party services, including outages, hacks, exploits, governance changes, or losses arising from their acts and/or omissions.
16. Cookies and analytics
We may use cookies or similar technologies to enable core functionality, remember preferences, and measure/understand usage to improve the Platform. You can control cookies through browser settings and consent or pop-up controls as described in the Privacy Policy.
17. International use
We may use service providers that process information in other countries. Additional terms may apply for use with those service provides.
18. Changes to the Platform and Terms
We may modify, suspend, or discontinue features (including token mechanics and gameplay systems) at any time.
We may update these Terms by posting an updated version. Continued use of the Platform after updates constitutes acceptance of the updated Terms.
19. Suspension and termination
We may suspend or terminate your access immediately if we reasonably believe you have breached these Terms, pose a security or a compliance risk, or where required by law. You may stop using the Platform at any time.
20. Disclaimers
To the maximum extent permitted by law, the Platform is provided “as is” and “as available.” We do not warrant uninterrupted operation, security, or error-free performance.
We do not warrant that Digital Items or $FES will have any particular value, availability, utility, or compatibility with third-party systems.
21. Limitation of liability
To the maximum extent permitted by law:
we are not liable for indirect, incidental, special, consequential, or exemplary damages (including loss of profits, loss of data, or loss of goodwill);
we are not liable for losses arising from blockchain networks, smart contracts, third-party services, wallet providers, or transactions/approvals you authorise;
we are not liable where we cannot delete or modify public on-chain information controlled by blockchain networks or third parties.
Australian Consumer Law. Nothing in these Terms excludes, restricts, or modifies any consumer guarantees or rights that cannot be excluded under the Australian Consumer Law or other applicable law. Where liability cannot be excluded, it is limited to the minimum extent permitted by law.
22. Indemnity
You agree to indemnify and hold us harmless from claims, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Platform, your breach of these Terms, your User Content, or your violation of any law or third-party rights.'
23. Governing law and jurisdiction
These Terms are governed by the laws of Western Australia. You submit to the non-exclusive jurisdiction of the courts of Western Australia and the Commonwealth of Australia.
